Bassett has scheduled additional interviews. "I do not believe that Cedric was intoxicated when his boat was boarded by the LCRA officers for a safety inspection," Bassett said Thursday in an e-mail to the Tribune. "I also am concerned that the force used by the LCRA officers, particularly the use of pepper spray, was not necessary under the circumstances."Bassett, perhaps best known in Austin for defending a man convicted last year of murdering Texas student Jennifer Cave in a case that drew national attention, takes over for Brian Carney. Carney has been a friend and ally of Benson's since high school but his office is in Benson's hometown of Midland, Texas--300 miles from Austin."There is a lot of work left to be done and I am not privy to all information regarding the case at this juncture," Bassett said. "Cedric is interested in focusing on football right now and we will work hard for him while he prepares for the season."Benson faces a May 19 court date but can be represented by Bassett. That also is the first day of organized team activities at Halas Hall, an important step for a running back coming off ankle surgery fighting for the NFL life in Chicago--even before last weekend's arrest.Another eyewitness has emerged to support Benson's claim that he was mistreated.Toby Patch was at nearby Emerald Point Marina on Saturday night when he claims he saw police "manhandling" Benson after taking the running back off the boat and heading to a squad car. Patch was not one of the 15 people on the boat."As they were taking him up the dock, they stopped, he said, 'I am fine, I can continue walking,' and they put their legs behind his knees and knocked him over his knees and started hog-carrying him," Patch told KXAN-TV in Austin.Near the parking area, Patch says the treatment of Benson worsened."They ended up--I don't know why--but laid him on his back, I heard him say, 'Please don't pepper spray me, please don't pepper spray me,'" Patch said. "It was uncalled for, it was ludicrous, no point for it."Patch's version sounded similar to the account Benson friend Elizabeth Cartwright, who was on the boat, gave the Tribune on Tuesday night.Benson is back in Chicago and has not commented since proclaiming his innocence Sunday night and saying police mistreated him. He is considering a lawsuit.
No surprise here. I believed Ced from the get go, and I am not a Ced fan whatsoever. The cops story reeked of something wrong.
This just proves Ced's credibility of his story more. This is not a friend of his. It was a complete stranger who saw this happen.
I hope Ced sues those POS police officers for all there worth if this is true
Usually, when you get two accounts that are as far apart as Benson's and the cops are in this case, there's usually truth to both sides of the statements.
Was Benson drunk? Maybe but usually they just give warnings os even if he was it shouldn't have been the big deal it was made out to be.
Was Benson less than cooperative? More than likely, I doubt the "yes sir, no sir" that Benson said he was like.
Did the cops overreact? Probably. The knew that physically he could hurt them in a fight and weren't about to let him have the opportunity.
Did they use too much force? Probably, in their minds they were playing it safe. Lets not forget their human, got scared and angry.
That's the way I think it happened.

Word. Having another witness that wasn't on the boat backing him is huge. It's also good to hear. And I'm sure will benefit Cedric tremendously in court, and in NFL/team punishment issues, if any.
Having seen what I have seen with cops I don't believe or trust 90% of them anyway. The more thats coming out about this case the more people will realize that cops are givin a pass MOST of the time and pretty much anything they say is ruled the truth. There are ALOT of cops who take advantage of that and they give a real bad name to the many many good cops out there just doing their job.
I'm sure in the tape we'll hear Ced get mouthy or upset but that does'nt give the cops the right to do the stuff they seem to have done. Glad to see an eyewitness come forward who was'nt on the boat to back up the story. Thats what it takes when the cops get rough. Lord help ya if there arnt any wittnesses.

This is becoming a joke so far the cops have been accused of every thing but stealing money from the church poor box and I'm sure soon there will be a witness to that.
1. 911 call saying benson is being beaten by cops by a witness who said she heard but not saw this happen and later changed her story to I saw him leaning over it looked like he was cuffed.
Benson never said he was beaten it 's not part of the complaint.
2. next you have Toby patch who infers Benson was pepper sprayed in the parking lot because he heard Benson yell please don't pepper spray me
Benson says he was pepper sprayed on the boat before he was cuffed and that in the parking lot he was pleading with the cops not to spray him with water
3. witness's fiance has pictures showing Ced doing sobriety test that will prove he is innocent and will give them to Ceds lawyer
Let's see pictures taken with a cell phone camera at 9.30 at night from a distance as opposed to a audio tape of the arrest made on the same boat that Ced was on interesting choice.
4. pepper spray , not letting him walk off the boat on his own feet.
While I don't like this part I will wait to hear the audio tape
Let's face it the only people that know what happened on that police boat are Ced and the cops . the audiotape may prove the case for either side, it may show if the use of pepper spray was justified or not
But until then your case of police brutality consists of no beatings , carrying a person off a boat instead of letting him walk on his own, washing the pepper spray off his face with a hose, and handcuffing a person who was under arrest. and of course having the mistaken idea that you should carry out your job even if it means confronting the pride of Texas and Chicago football who by the way has a record of smoking grass in a state where a man is doing a life sentence for the crime of SMOKING GRASS.

Everyone cries police brutality, whether it's being shoved to ground with a knee on your head, or being slammed against the hood of a cruiser. It's all bîtch, bîtch.
Did Ced say say he was Kneed in the head or slammed into anything No he did not did he claim he was beaten No he did not Was he pepper sprayed yes he was Was it justified who knows . But you people are sceaming police butality When even Ced says he was mistreated never said a word about police brutality
My guess is you people at some point got a ticket or got busted for some small law and of course it was not your fault, the cop lied he just picked you out of 300 other people because he had nothing better to do
I always went by the idea if I got busted for 1 thing it kind of balanced out the other 500 things we get away with all the time , all the times we drive home buzzed and dont get busted and just because you didn't get caught , doesn't mean you wer'nt breaking the law . But all you can think about is the one time you did get caught and what a beotch the cop was for doing his job when of course you were innocent.You know of course there are no guilty people in prison just ask them.
My last rant how many of you people were the victim or have even seen actual police brutality and I don't mean on TV I have and I can tell you first hand you don't come out looking like Ced did , you look more like you went through a meat grinder
He said 6 times in 2 years only 2 times this year that means of 4 or 5 lcra crews he may have gotten stopped 1 time each crew. Was it harrasment maybe ,One poster says because they checked his boat so often and it always passed , That all the crews should have known it and not checked it again because they could read the report showing it passed.
I could be wrong but I would guess no report is filed unless they find some thing wrong on board just like a traffic stop if you're not issued a ticket no report gets written
As Ced says it was only the second time out this year no mention of how long between outings and this time they tied up in an area known to the cops as a party and drinking area
